In the State of Kansas, legal next-of-kin is defined in Kansas Statutes, Chapter 65. Next-of-Kin relationship is granted in this order:
1. An individual listed in a Power of Attorney with the authority to make decisions for disposition of decedent’s remains
2. Surviving Spouse
3. Surviving Children
4. Surviving Parents
5. Persons in the next degree of kinship in inheritance law
6. Guardian at the time of death
7. Personal Representative of the deceased
8. State, County Public Official in charge of indigent disposition
1. An individual listed in a Right of Sepulcher document
2. If the deceased is an active duty military personnel, the person listed in their Record of Emergency Data form
3. Surviving Spouse
4. Children who have reached the age of 18
5. Surviving Parent
6. For children under the age of 18, the parent with custody of the minor child
7. Surviving Siblings
8. Friend or other party accepting financial responsibility
9. County Coroner or Medical Examiner
